ARTICLE 1 – ORDERS

The Client can place their order by several means. For all orders placed on the website www.stockart.com, the contractual and legal information is presented in the chosen language. Orders on the stock-art.ch website are made via a secure connection. Stock Art reserves the right for orders from a foreign country with a suspicious payment method (suspicious credit card, banking risk, customs risk...) not to proceed with the delivery of the order without having carried out additional checks which could delay delivery times. Stock Art also reserves the right to cancel or refuse any order from a Client with whom there is a dispute relating to the payment of a previous order, or for any other reasons without explanation. Any Client's order, which has been confirmed by sending an order confirmation, is considered firm and final, from its receipt by Stock Art. Any modification of an order, for whatever reason, requires the prior written agreement of Stock Art. Delivery of an order will only be made upon complete receipt of the order's payment by the Client.

ARTICLE 2 – PRICES

All prices shown are public prices and are in Swiss francs, inclusive of all taxes. Unless otherwise stated, prices shown on the website are in Swiss francs (CHF), VAT included. Prices may be displayed in foreign currencies, based on the daily exchange rate, but payment will be debited in Swiss francs. The prices indicated on the website at the time of the order apply. We reserve the right to modify the price of the Products at any time. In the case of an order to a country other than Switzerland, any customs duties or local taxes will be the responsibility of the recipient. All orders, regardless of their origin, are payable in Swiss francs. In the case of the amounts of installments indicated, it is the final amount based on a calculation by our financial partner, subject to the acceptance of both parties. The products remain the property of Stock Art until the complete payment of the order by the client.

ARTICLE 3 – PRODUCT AVAILABILITY

Our offers of products and prices are valid as long as they are visible on the site, subject to stock availability. Some products marked "On request" are not in stock but can be ordered from our suppliers. Information on product availability is provided in any case at the time of placing your order. In the event of product unavailability after placing your order, Stock Art will indicate a new delivery time without delay and by all means, upon receipt of the information received. In this case, the client may cancel their order. In case of failure, impossibility to deliver, or for any other reasons, Stock Art reserves the right to cancel all or part of the orders already paid and undertakes in this case to reimburse the Client any amounts already paid. We may have to refuse, delete, or cancel an order after its confirmation, for any reasonable reason. In this case, you will be informed of the delivery of a partial order or the cancellation of your order. If you have already paid for certain Products, we will refund the full amount of the Products concerned and any delivery charges charged as soon as possible. We may also refuse an order in the case where a dispute exists concerning the payment of previous orders or in the case of abnormal orders and orders for which Stock Art suspects that they have not been made in good faith.

ARTICLE 4 – PRODUCT DELIVERY

Any order will be processed upon receipt of full payment from the Client. The time taken to validate the payment and dispatch the order varies depending on the chosen payment method. In any case, Stock Art reserves the right not to proceed with the delivery of an order if there is a doubt about the integrity of the Client's payment. The delivery of ordered products is made to the delivery address indicated by the Client during the ordering process. Stock Art cannot be held responsible in case of error in the indication of the delivery address by the Client. The average delivery time is 7 to 14 days from the date of receipt of full payment by the Client. These times are indicative and may be longer due to high demand, product rarity, availability from our suppliers, or as a consequence of the current period. The final deadline will be communicated to the Client by email with the order confirmation. For any order from abroad, the delivery time may vary depending on various parameters (payment method, country of delivery, customs fees...). The risks and costs related to transport are entirely your responsibility and you acknowledge that Stock Art assumes no risk of loss, theft, delay, or any other damage related to the delivery of your order. You are required to check the Products immediately upon receipt with all the required attention and note any manufacturing defects affecting them. Unless notice of defects is sent by registered mail within 14 calendar days after delivery, specifying the nature of the defects found, the Products are considered accepted. Defects that could not be detected upon receipt (hidden defects) must be notified to us by registered mail within 10 calendar days following their appearance, failing which they are definitively considered accepted.

ARTICLE 5 – PAYMENT

The site www.StockArt.com uses a secure payment platform that guarantees optimal reliability in protecting your banking data. Products can be paid for either by the usual means of payment indicated on the website (bank transfer, credit card, Paypal, Apple Pay, Google Pay), or by external financing under the conditions of the article below. For Products between CHF 2,000.- and CHF 15,000.-, you can request financing at 0%. To do this, you can make a financing request, subject to acceptance, and conclude a contract with Stock Art. Then, the debt is assigned to our partner by the financing contract between you and Stock Art, we decline all responsibility in connection with loans or credits approved by our partner. Obtaining financing is subject to the conditions of our partner, in particular: you must be at least 25 years old, be domiciled in Switzerland and have Swiss nationality or hold a B or C establishment permit. Financing contracts must be fully amortized before your 65th birthday. You must provide the information and documents required in the checkout or by email for the correct establishment of your request.

ARTICLE 6 –RETRACTION & RETURNS

The Client has a withdrawal period of 7 calendar days from the receipt of the order placed on our website. The client must send us by email at the address assunta@stock-art.ch their return request. The costs of returning the product are the responsibility of the Client, who must ensure to deliver the product by secure express delivery through the carrier that Stock Art will choose. In the context of a purchase by financing, the legal withdrawal and return period governed by the general conditions of our partner starts to run from the signature of the financing contract. No watch can be returned after the deadline except in the case of the article 4 of these general terms and conditions of sale. Unless otherwise stated, returned Products will be exchanged or refunded within 30 days following the date we receive them, by the means of payment used when ordering the Products. The refund may be made by the same means of payment as for the purchase or another means of payment without additional costs for the Client. Note that in the case of payment by credit card, Stock Art will refund the Client deducting the collection fees related to the initial payment made by the Client. All products must be returned in new condition. It is important not to wear the product as long as you are not certain to keep it. It is essential that all plastics, labels, and protective accessories are intact. Stock Art reserves the right to unilaterally cancel an order without justification.

ARTICLE 7 : PAYMENT SECURITY

The site www.stock-art.ch is subject to a payment means and personal data security system: We use the SSL encryption process, a payment platform, and all scrambling and encryption processes to protect as effectively as possible all sensitive data related to payment means.

ARTICLE 8 – INTELLECTUAL PROPERTY

The Stock Art brand is a registered trademark with the Federal Institute of Intellectual Property. All texts, comments, works, illustrations, and images reproduced on the www.stock-art.ch site are reserved under copyright and intellectual property rights worldwide.

ARTICLE 9 – WARRANTY

Some watches also come with a Stock Art warranty valid for two years from the date written on it. This card is non-transferable and is only valid for the initial customer. This warranty is subject to the same defect coverage conditions as the Brand's warranty. This Warranty is only valid at Stock Art.

ARTICLE 10 – APPLICABLE LAW – DISPUTES

This contract is subject to Swiss law. The language of this contract is French. In case of dispute, the Swiss courts of the jurisdiction of the registered office of the company Stock Art will have exclusive jurisdiction. In case of divergence between the general terms and conditions of different languages, the French text shall prevail.

ARTICLE 11 – PERSONAL INFORMATION

Stock Art is registered in the commercial registry of the Canton of Vaud under the number CHE105538164. Stock Art commits not to disclose to third parties the information, considered confidential, that you communicate to it. These will only be used for processing your order and to enhance and personalize the communication and product offerings reserved for Stock Art customers, particularly through newsletters to which you may have subscribed. Furthermore, the Stock Art.com platform uses cookies to better meet the expectations of its customers and visitors. Therefore, cookies are used by Stock Art solely for the purpose of improving the personalized service intended for you.
